VAT

From 1 May 2020 different rates of VAT apply to some eresources:

  • Standard rate applies to PsycTherapy video content and to Service Provision from both providers.

This Agreement is of 3 years duration. Institutions may join the agreement at any time during the agreement period. They will then be committed to the end of the Agreement Period unless they have taken a single year commitment AND provided appropriate cancellation notice.

Eligible Institutions

Higher and Further Education and Research Councils in the United Kingdom, and to Universities and Colleges of Further Education in the Republic of Ireland.

Other organisations aligned with Jisc’s charitable objectives of supporting education, research bodies and the public sector may ask to participate in the Agreement. Chest will liaise with the Supplier about any such requests.

Terms and Conditions

The Chest Order, together with the Licence Terms and Conditions, and any exceptions listed below, create a legally binding contract between your institution, organisation or company and the Licensor. Therefore please read the terms and conditions carefully and only submit a Chest Order if its terms and conditions are acceptable to your institution, organisation or company and you have the authority to make the financial commitment shown.

Licence

This agreement is not based on Standard Chest Agreement terms and conditions. Please make sure you read and accept APA's PsycTHERAPY licence terms.

There is one exception to these terms listed at the bottom of this page.

Payment Terms 

Pricing comprises two elements, the Data Fee and the Service Provision Fee. They are based on student FTE numbers. FTE Counts are taken from the HESA Statistics Table 2 for 2015/16 (the latest available at the time of contracting) or or FE and Ireland equivalent. Institutions once banded remain in this band for the duration of the agreement irrespective of whether their actual FTE count changes during that time.

HE Institutions can check their HESA Student FTE Number.

PsycTHERAPY is only available through APA PsycNET platform. Please check the spreadsheet for the appropriate fee. Contact Chest Help if you need advice.

The licence year is 1 August to 31 July. All licences terminate on 31 July 2020. Single and three year options are available. Monthly prorata charging applies to licences ordered partway through the licence year.

Please submit an order for the data fee. Chest Help will email you to confirm the final price, including Service provision, owed.

All terms contained in a PO are expressly rejected and do not form part of the Licence or vary the Licence terms in any way.

Institutions will be invoiced by Jisc in either pounds (£ UK) with the amount converted at the time when the invoice is raised or by arrangement in US $.

Payments are due within thirty days of invoice date; recipients of late payments are entitled to interest in accordance with UK statutory provisions.

What can authorised users do?

The resources can be used for Educational Purposes – defined as:

  • education
  • teaching
  • distance learning
  • private study
  • academic research
  • administration and management of the Licensee’s educational or research operations

Exclusions:

  • See the Licence for any exclusions and restrictions
  • The resources may not be used for anything other than Educational Purposes unless the Licence Extension for Commercial Projects has been bought; this allows use for the restricted “Commercial Projects” defined – see Annex B of the Licence (Licence Extension for Commercial Projects)
  • Downloading of large amounts of material by authorised users that might be considered ‘systematic’.

Termination Clauses

Subject to any Fee shown on the Website, the Licensee may retain an electronic copy of the Licensed Material in its archives for reference only.  Copies of parts of the Licensed Material already made and/or used by the Licensee or Authorised may be retained and used in accordance with the terms of this Licence Agreement.

It is the intention of Eduserv and <Supplier> to renew this <n> year Agreement. If the Agreement is renewed or extended, then new conditions may apply. If the Agreement is not renewed, then any extension is a matter between institutions and <Supplier>.

Personal Licences

Personal licences are not available.

Exceptions to the Terms and Conditions

There is one exception to the Licence terms – the applicable law, has been agreed with APA and states the licence is governed by the laws of England and Wales.
